Dear Progressive Secretary Supporter

Here is a new Progressive Secretary letter.

This letter supports an action by The Leadership Conference on Civil and Human Rights, a coalition of more than 200 national organizations committed to promoting and protecting the civil and human rights of all persons in the United States (https://civilrights.org/about-us/coalition-members-leadership-conference-civil-human-rights/).

Please vote “NO” when asked to confirm Michael Brennan to the Seventh Circuit Court of Appeals.

Mr. Brennan has a radical view of legal decision-making. He believes that judges should uphold their personal views of what the Constitution means instead of adhering to established interpretations.

Commenting on Hamdi v. Rumsfeld, Mr. Brennan wrote that the government could detain enemy combatants indefinitely and deny them a hearing (habeas corpus). In that case, the 2004 Supreme Court upheld the detainee's right to a hearing. Brennan could well use his position as a Court of Appeals judge to overturn that decision, since he doesn’t believe in honoring precedents.

Michael Brennan is clearly unsuitable for a position on a federal courts Please vote “NO” on his confirmation.
